These Terms of Service ("Terms" or “ToS”) cover your use of our website, our web-based learning platform, and our mobile applications on iOS and Android (“Sparkli App”), and all educational content, and related services provided through these platforms (collectively referred to as "Sparkli" or the "Service").

By creating an account, downloading the Sparkli App, or using - or allowing children to use - Sparkli, you agree to these Terms. If you do not agree, you must not use our Service.

While Sparkli is an educational experience designed for children (ages 5–12), accounts must be created and managed by an adult (Parent, Legal Guardian, or Educator) over the age of 18 with full legal capacity.

If you are an Educator using Sparkli on behalf of a school or institution, you confirm that you have the appropriate authority to do so. You also agree to manage any necessary parental permissions or consents for your students.

4.1 Ownership, Our License to You

‍We retain sole and exclusive right, title, and interest in and to the Service, and all related intellectual property rights, including all software, text, graphics, audio, video, interactive features, content, and brand assets. This includes, but is not limited to, our "Expeditions," the "Curiosity Map" logic, source code, user interface designs, and all underlying technology. Nothing in these Terms grants you any right to use our brand assets or logos without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Service for personal, non-commercial use (or authorized internal educational use).

To protect the integrity of Sparkli, you agree not to:
1. Technical Misuse: Attempt to reverse engineer, decompile, disassemble, or hack any aspect of the Service, specifically including our algorithms and assessment logic;
2. AI & Data Scraping: Use any content, data, or output from Sparkli to train, fine-tune, or test any artificial intelligence, machine learning models, or competing algorithms. Scraping or automated data extraction is strictly prohibited.
3. Copying & Derivatives: Copy, modify, distribute, sell, or lease any part of our Service or content.

‍4.2 Your Content

‍You (or the student) retain full ownership of any content uploaded to Sparkli ("User Content"). However, by using the Service, you grant us a worldwide, royalty-free license to use and process such User Content solely to:

1. Provide the Service: Including displaying progress and generating "Curiosity Map" insights; and
2. Improve the Service: Including internal analysis to refine the learning experience and ensure the content meets user needs.

5.1  Current Status:

1. Free Early Access Until further notice, the Service is provided free of charge for Early Access and testing purposes.
2. No Payment Data: We do not currently collect credit card numbers or payment details.
3. No Surprise Charges: You will never be charged retroactively for your use during the free Early Access phase.

5.2 Future Subscriptions & Pricing 

‍We reserve the right to introduce subscription fees or paid features upon our public launch. Any information regarding subscriptions (Monthly/Annual) and free trials displayed on the website is indicative and for informational purposes only.

‍Notification: We will provide clear notice before any payment obligations begin. You will have the choice to subscribe or stop using the Service at that time.

5.3 Terms Applicable to Future Paid Subscriptions 

‍If and when you choose to purchase a subscription (e.g., monthly, annual) in the future, the following terms will apply:

1. App Store Purchases: If you subscribe via Apple or Google, the transaction is handled directly by them. You must manage cancellations and refunds through your Apple ID or Google Play account. Sparkli cannot directly refund App Store purchases.
2. Auto-Renewal: Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period.
3. Price Changes: We will provide reasonable notice of any price increases. If you do not agree to the new price, you must cancel before the next billing cycle.

We may update these Terms as Sparkli grows. If we make material changes, we will notify you via email or an in-app notification. Continued use of the Service after changes constitute acceptance.

You may stop using Sparkli and delete your account at any time.
1. Effect on Subscriptions: If you cancel a paid subscription, your access will continue until the end of the current billing cycle. You will not receive a refund for any partial subscription period, and you remain responsible for all fees incurred up to the end of that cycle.

We reserve the right to suspend or permanently terminate your account immediately if you breach these Terms (including, but not limited to, abusive behavior, payment fraud, or violation of our content restrictions).
1. No Refunds for Breach: If your account is terminated for a violation of these Terms, you forfeit any prepaid subscription fees and are not entitled to a refund.If we exercise our right to discontinue the Service entirely (as described above) or terminate your account for reasons other than your breach of these Terms:
2. Pro-Rata Refund: We will provide you with a pro-rata refund for any prepaid but unused portion of your subscription term.
